Terms of Use Callebaut Traceability Tool

Barry Callebaut has set up the present online tool (the “Tool”) - accessible through the www.callebaut.com website - in view of providing its customers with additional information regarding the composition and traceability of some of its “Callebaut” branded products (the “Data”).

Your access and use of the Tool is subject to the terms of use set out herein (the “Conditions”). These specific Conditions are complementary to the general terms of use[MV1]  that govern your use of the www.callebaut.com website. By accessing and using this Tool, you accept, without limitation or qualification, the Conditions set out herein.

Barry Callebaut reserves the right to modify or revise these Conditions from time to time, in its sole discretion, by updating this posting. You are bound by any such revisions.

The term “Barry Callebaut” refers to the entity of the Barry Callebaut group that is responsible for the Tool, in particular Barry Callebaut AG, Pfingstweidstrasse 60, 8005 CH, Zürich, Switzerland. Where appropriate, the term “Barry Callebaut” may also refer to any other affiliate member of the Barry Callebaut group.

The Tool is only targeted at professional (business to business) customers and only business to business customers are intended to use the Tool.

You should assume that everything made available through the Tool is protected by intellectual property laws. Copyright works subsist in the content available on the Tool, individually and collectively, as well as in the entire source code used for the deployment of the Tool. No use of any of the foregoing may be made without the prior written authorization of Barry Callebaut.

Permission is given for the temporary storage of the Tool’s web pages for the purpose of viewing on a personal computer, monitor or mobile device. Any other use is expressly prohibited.

Barry Callebaut reserves the right (but does not assume any responsibility) to delete, modify or supplement the content of this Tool at any time for any reason without notification to anyone, and to terminate any user's access to all or part of the Tool.

The Tool, the content thereof and the Data provided on or available through the Tool are provided on an “as is” basis, with all faults.

Barry Callebaut will use reasonable efforts to include up-to-date and accurate Data on this Tool, but makes no representations, warranties or assurances as to the accuracy, completeness, or fitness for a particular purpose of the information provided.

You acknowledge and accept that, to the extent the Data provided through the Tool includes nutritional and/or ingredients data, such data will be provided and expressed in accordance with the relevant European Union legal requirements.

To the extent permitted by the applicable law, Barry Callebaut shall not be liable for any losses or damages, whether of a direct or indirect nature, resulting from your access to, use of or inability to access this Tool, or from your reliance on any information provided through this Tool. You agree to be fully responsible for and indemnify Barry Callebaut from and against any and all liability and/or damage arising out of or claims resulting from your access and/or use of the Tool.

You agree that the laws of Switzerland without regard to conflicts of law principles thereof, shall apply to all matters relating to the use of the Tool and these Conditions. In case of a dispute, you agree to submit to the exclusive jurisdiction of the courts of Zürich, Switzerland.

These Conditions were last updated on 14 November 2019, and are effective as of that date.
